HC seeks presence of UP police over arresting a couple from Delhi without Delhi Police

Upon hearing a case in which two people — the father and brother of a man who married a woman against her family’s wishes — were arrested and taken away by the UP Police without informing the Delhi Police, the Delhi High Court has ordered the Station House Officer of Shamli police station in Uttar Pradesh to appear in person before it on October 28.

“It is basic law that the father and brother of the petitioner No. 2 (husband) could not be detained by U.P. Police and transported from Delhi without telling Delhi Police,” Justice Mukta Gupta stated while hearing the couple’s case.

“Justice Gupta described it as “unfortunate” that arrests were made by U.P. Police without determining if the woman was an adult or a minor or checking the facts with her.

The couple told the court that they married in July against the woman’s family’s wishes, and were receiving threats from them.

According to the petitioner, the husband’s father and brother were taken away by U.P. Police from their residence in Delhi, and their whereabouts have been unknown for more than a month.
