Kangana Ranaut approaches for quashing the defamation case filed by Javed Akhtar at the Bombay HC

Javad Akhter, a lyricist, has filed a defamation complaint against actress Kangana Ranaut. Subsequently, the  Bollywood actress has moved to the Bombay High Court for quashing the defamation proceedings that were initiated at Andheri by the metropolitan magistrate on the complaint filed by the lyricist.

Kangana has challenged the entire proceeding which was initiated by the metropolitan magistrate which includes the complaint of Javed Akhtar, orders, summons that was issued to date.

Petitions filed by the actress also stated that, According to Section 202 of the Criminal Procedure Code, 1973, the magistrate was obliged to examine the complainant and the witness which is in the complaint. Instead, the magistrate has directed the Juhu police, Mumbai to conduct an inquiry on his behalf. By this Ranaut contended that the magistrate has not conducted the inquiry using his power but instead he has conducted an inquiry by the police officer.

Ranaut also stated that the witness’s statement can get easily influenced by the police and emphasized that if this practice is allowed then it would for the other magistrate set a wrong precedent and also the rights and liabilities of the accused will be affected.

This matter was further listed for hearing on 26th July 2021 before Justice SS Shinde and Justice NJ Jamadar.
