Karnataka HC: Removes clause assessing students on last semester marks

The Karnataka High Court fairly recently did away with Clause 7 of the guidelines that were issued by the Karnataka State Law University according to which any candidate who secures less than forty per cent of marks as of an aggregate percentage system of the total performance which is inclusive of theory and internal assessment of marks in the previous semesters shall be called as ‘fail’.

The High Court told the University to go according to the previous order issued by them in the case of Bala Nagaraj, wherein it had told the University to assess the first to fourth-year students of BA LLB, on the basis of their internal assessments’ marks to an extent of fifty per cent and the remaining fifty per cent of the marks to be judged the basis of their performance in the previous semesters only.

Since there is no visible ambiguity in the orders that were passed by this Court, it doesn’t really hold much significance whether a student who failed in the previous semester should be declared as pass in view of the fifty-fifty formula that was directed and adopted by this Court.
