Madras HC Tells Educational Authorities To Be More Sympathetic Towards Children During The Pandemic Period

The Hon’ble Madras High Court has stressed more sympathy and concern towards children by the educational authorities, particularly in this pandemic crisis.

The Hon’ble Single Judge Bench of Hon’ble Justice Anand Venkatesh remarked that “children who are already experiencing stress for being confined in their houses cannot be put under more pressure and their problems need to be addressed with a soft corner.”

The Hon’ble Court was dealing with a petition wherein the son of the petitioner who was enrolled in the 10th class for the academic year 2020-2021 was not declared ‘passed’ on the ground that he did not fulfill the required attendance.

The petitioner contended that his son was not declared passed according to the Government policy on account of his name being left out by the school he was studying in while submitting the list of the candidates.

The Government Order dated 25.02.2021 was referred by the Hon’ble Court where it was found that the fulfillment of attendance criteria is not mandatory to avail the benefit under the said Order.

The order was given to declare as ‘pass’ all those students enrolled in classes 9 to 11 after the Government finding it difficult to conduct examinations during the Covid-19 pandemic.

Therefore, the Hon’ble Court has held that the son of the petitioner is entitled to be declared ‘passed’ and also directed the respondent authorities to implement the same within two weeks.
