The instant protection Plea with costs 5k that is filed by a woman. The plea got dismissed by the Hon’ble Allahabad High court keeping in the note that the woman is already married and is living in a live-in relationship with another man.
The Hon’ble division bench consisting of Hon’ble Justice Kaushal Jayendra Thaker and Hon’ble Justice Dinesh Pathak clearly stated that they cannot allow the petition because if allowed then it would be permitting illegality in the society.
The Hon’ble court further stated that the protection cannot be given to those who commit what can be said to be an act that is against the provision of the Hindu Marriage Act. Although if we talk about Constitution, Article 21 though provides with the right to life and personal liberty that has to be within the Ambit of the law that applies to a particular person.
