Raj Kundra moves Mumbai court for bail in the porn film case

Businessman Raj Kundra, who is one of the accused in the porn film case, has pleaded for a regular bail in a Mumbai Court on the grounds that the investigation concerning him has been completed by the Mumbai police.

The Mumbai Police Department’s Crime Branch has filed a detailed supplementary chargesheet against four people, including Kundra, indicting them as the accused.

Kundra pointed out that after the filing of the chargesheet, it was clear that the investigation against him had been completed and that he was now entitled for a bail. Kundra also said that after the chargesheet was filed against the nine suspects, eight were granted bail by the Court. Kundra now is seeking for a bail stating equality as the other accused, through an application filed by Advocate Prashant Patil.

Kundra went on to say that although there was not much evidence against him in the first chargesheet, he was arrested and that after a “prompted investigation” was carried out and a supplementary charge sheet was filed.

Some of the reasons for seeking bail in Kundra’s application are as follows:

That he is a permanent citizen of India with deep roots in the society. It also stated that Kundra was associated with the company that owns mobile apps – Hotshot and Bollyfame – only for a period of 10 months and during this period he had interacted with only a few clients of AMPL, but never took any part in content creation or contract building.

It was also mentioned that by simply reading the statements of the so-called “witnesses”, it is clear that the victims were adults, and were voluntarily committed to the so-called “video shoot”. 

Kundra also mentioned in the application, that the unprecedented COVID-19 pandemic situation poses a potential health hazard for him.

Mumbai police arrested Kundra and produced him before the Metropolitan Magistrate at Esplanade, where he was remanded in custody until July 23, 2021, which was then extended upto July 27. His bail application was rejected on 28th July, 2021 by the Magistrate Court.

Kundra also went to Mumbai Sessions Court seeking bail after his bail plea was rejected by The Magistrate Court. The police filed a reply against the bail application and the Sessions Court also issued notice.

However, after the filing of the chargesheet, the application was withdrawn with the freedom to file a new application before the Magistrate.

His application for remand to custody and the subsequent orders of the Metropolitan Magistrate Court in the porn film case was rejected by the Bombay High Court on August 7, 2021.The latest bail plea is scheduled to be heard by the Chief Metropolitan Magistrate, Esplanade, Mumbai on 20th September 2021.
