The Personal Grievance Cannot be Redressed Through PIL: Allahabad HC

In a PIL seeking to issue a Writ like a Mandamus to direct  UP Government to take cognizance of various findings/recommendation of the Report of Sanjay Bhoosreddy Special Investigation Team and to take all appropriate legal and administrative actions as per the above-mentioned findings/recommendations is dismissed along with costs of Rs.25,000/- by Hon’ble Allahabad High Court.

The Hon’ble bench comprising Hon’ble justice Sanjay Yadav and Hon’ble Chief Justice Ritu Raj Awasthi held that “the petitioner has approached this Court to have his grievance redressed through a mode of public interest litigation. The personal grudge has to be settled under law before appropriate forum and not through litigation depicting to be a public interest”

The instant case is relating to a Gangster Vikas Dubey who is killed in an encounter. After which, SIT led by Sanjay Bhoosreddy recommended action against 90 government officials to have aided Dubey in his illegal activities.

Subsequently, a three-member inquiry commission headed by a supreme court judge turned down allegations of government officials to have aided Dubey. Further to this Hon’ble supreme court had dismissed the plea for disbanding of the inquiry commission on allegations of bias.
