About the Job :
India Law LLP is inviting applications for the position of Associate- Litigation to join their team in Chennai. If you have 2 – 5 years of PQE in IBC, banking litigation, commercial litigation or a closely related practice, this opportunity is for you.
Eligibility :
(i) LL.B. from a recognized university/institution.
(ii) 2 – 5 years PQE in IBC, banking litigation, commercial litigation or a closely related practice.
(iii) Strong hands-on experience with NCLT/NCLAT proceedings is preferred.
(iv) Experience with DRT/DRAT and SARFAESI matters will be an advantage.
(v) Good understanding of the Insolvency and Bankruptcy Code, 2016, Companies Act and banking/recovery laws.
(vi) Strong drafting, legal research and oral advocacy skills.
(vii) Ability to independently manage matters, meet deadlines and handle multiple assignments.
(viii) Good communication and client-management skills.
(ix) Willingness to travel/appear before courts and tribunals when required.
(x) Bar Council enrolment is essential.
Responsibility :
(i) Handle and assist in IBC proceedings before NCLT, including matters under Sections 7, 9 and 10 of the Insolvency and Bankruptcy Code.
(ii) Draft and review petitions, applications, replies, rejoinders, written submissions, affidavits and interlocutory applications.
(iii) Appear before NCLT, NCLAT, High Courts and other judicial/quasi-judicial forums, as required.
(iv) Handle matters relating to financial and operational creditors, CIRP, liquidation, resolution plans and recovery proceedings.
(v) Assist in litigation involving banks, NBFCs and financial institutions, including recovery and enforcement matters.
(vi) Work on matters under SARFAESI Act, Recovery of Debts and Bankruptcy Act (RDB Act) and related banking laws.
(vii) Assist in proceedings before DRT/DRAT, including recovery applications, securitisation applications and appeals.
(viii) Conduct legal research on IBC, banking laws, commercial laws and insolvency jurisprudence.
(ix) Prepare case briefs, chronologies, legal opinions and litigation strategies.
(x) Coordinate with clients, senior counsel, insolvency professionals, bankers and other stakeholders.
(xi) Track hearings, orders, limitation periods, filings and procedural requirements across matters.
(xii) Independently manage assigned matters and ensure timely completion of court/tribunal-related work.
