Allahabad HC Orders To Stop Encroachments On Kabaristan By Ant-social Elements

The Allahabad High Court in its single judge bench consisting of Justice Rahul Chaturvedi shed light on a Judicial Magistrate for advising the counsel on what must be done and furthermore passing a strange order.

In the matter that was before the Judicial Magistrate, there was investigation carried out and infact the applicant was impleaded as the accused party. The magistrate later stated that the power of removal of the name of the accused lies with the High court under S 482 CrPC.

Lastly, the High court also ordered the magistrate to pass only suitable orders within a fortnight from the date of production of certified copy of the order.
