CJM allows cops to question Arnab Goswami in Taloja Prison

The Magistrate had passed the order on November 06 allowing police to interrogate Goswami for three hours daily at Alibag. In Anvay Naik abetment to suicide case, the Chief Judicial Magistrate Court at Alibag allowed the police team investigating to interrogate Arnab for a specific time period daily at Taloja Prison.

The Raigad police had moved plea seeking permission to interrogate Arnab for a specific period daily in Taloja jail. Arnab Goswami was shifted from Alibag to Taloja jail on Sunday.The interrogation of Arnab has been granted in compliance with Maharashtra Prison Rules till the time he is able to obtain bail. 

Observing the further investigation in the case is not illegal and rights of the victim are also important, along with that of the accused, the Bombay High Court rejected Arnab’s interim bail plea. 

Application of regular bail was filed, and was expected to hear today. The Court decided to take up hearing the revision application filed by the police first. The revision application will be heard at 11 am today and the bail application may be heard thereafter.

The Bombay High Court in the order refusing interim bail to Republic TV anchor Arnab Goswami observed that, further investigation started by Raigad police in the Anvay Naik suicide case “cannot be termed as illegal and without seeking permission of the Magistrate.”

Justice SS Shinde and Justice MM Karnik while rejecting the arguments raised by the Goswami’s lawyers, Senior Advocates Harish Salve and Abad Ponda, said that the police action against him was illegal as they could not have suo-moto revived the investigation after the Magistrate had accepted closure report in the case in 2019.

The story had reported that the order allowing police interrogation was passed by Alibaug Sessions Court today, but the same was a mistake and the copy has been corrected completely and error is deeply regretted.

As otherwise under law, police do not have access to an accused that is in jail custody without an order of the court. The court granted permission to interrogate On Monday a 10-member squad of Raigad police interrogated Goswami and two others who are now lodged in Taloja jail for three hours, said Inspector Jamil Shaikh of Raigad crime branch, who is the investigating officer. The officer said that three teams interrogated Goswami, Firoz Shaikh and Neetish Sarda in the afternoon.
