Hathras Gang Rape Case: PIL in SC Seeking CBI/SIT Probe and Transfer of Trail

Bail application of three PFI members (alleged) rejected by Mathura Court

A plea was filed before the Supreme Court seeking investigation for the Hathras gang rape and brutal murder of a 19-year-old Dalit girl alleged to be committed by four upper caste men by either the Central Bureau of Investigation (CBI) or the Special Investigation Team (SIT).

The Petition was filed by Social Activist Satyama Dubey and Advocates Vishal Thakre and Rudra Pratap Yadav  

The Petitioners also prayed for the transfer of the trail from Uttar Pradesh to Delhi alleging failure of the state government in taking proper action against the accused.

On 14th September, a 19-year-old Dalit girl was abducted and gang-raped by four men of upper caste and then she was subjected to brutal torture. Her bones were broken and her tongue was cut. She passed away on 29th September and was cremated by the police officials without consent of her family members in the mid night.

The petition stated that:

  “…the Police Authorities had not performed their duties towards the victim and trying to shield the accused persons for reasons best known to them.”

Thus, the petitioners in the plea prayed for a fair investigation and to transfer the case either to CBI/SIT under the supervision of a sitting or a retired judge of the Supreme Court/ High Court.

The petitioners at last prayed for the transfer of matter from Uttar Pradesh to Delhi for speedy trail.
