Sixteen students filed a writ petition in the Allahabad High Court seeking full implementation of The Rights of Persons With Disabilities Act, 2016 and the directions given in the case of Rajive Raturi v. Union of India & Ors. by the Supreme Court.
The petitioners are students of various colleges. The petitioners had inspected eight buildings which were under government departments. Through their inspection they found that there were no adequate facilities available for the differently abled persons at those places.
The petitioners submitted that by not following the provisions of the 2016 Act and the directions in the Rajive Raturi case given by the Supreme court there is a violation and infringement of the right of differently abled persons under Article 14 and Article 21 of the Constitution of India.
The court granted time to the Standing Counsel who appeared on behalf of the respondents to file a response. The bench also gave directions to the District Social Welfare Officer, Prayagraj to file a report in relation to the inspection of all the government buildings in Prayagraj. The inspection has to be done in consonance with the 2016 Act and the directions of the Apex Court in Rajive Raturi case.
