Supreme Court to Resume Hearing In Hybrid Manner, Lawyers can Choose Between Either Physical Or Virtual Mode

The Supreme Court observed that a contract is void if prohibited by a statute under a penalty, even without express declaration that the contract is void

The Coordination Committee of the Supreme Court has recently clarified that the Supreme Court will resume with the hybrid manner of conducting the court proceeding in either a virtual or physical model. The Supreme Court along with the Supreme Court Bar Association and Supreme Court Advocates On Record Association came to this decision last Saturday. The parties who have cases before the court have the option to appear either physically or virtually. In the court, one party will be able to appear physically while the other party can appear virtually. The Court on the other hand will sit and hear the matter in the physical Courts. The Standard Operating Procedures and related details on how the Court will function are said to be released in the upcoming days.

Previously numerous requests have been made to the Chief Justice of India seeking to resume physical court proceedings. A joint was also made between the Executive Committee of the Supreme Court Bar Association and the Supreme Court Advocates On Record Association who decided to demand the resumption of physical hearings. The Supreme Court Advocates On Record Association also wrote separately to the Chief Justice of India requesting a hybrid resumption of physical hearings for the current virtual courts.
