Will There Be a Federal Law on Online Gambling in India?

India generally allows online gambling except for a few states that decided to prohibit all forms of gambling. The country has no federal laws that strictly ban online gambling activities.

Some refer to this situation as a grey area or a point that can lead to confusion and uncertainties. However, some view the situation as advantageous. The lack of federal laws that specify the country’s policy on online gambling has allowed many online casinos to operate in India. Offshore gambling sites also appear to be pursuing the Indian gambling market.

The need for regulation

If online gambling is legal in India, why is it that there are still calls for its regulation? This is a question some tend to ask regarding the state of online gambling in India. To emphasize, being legal does not automatically mean that the market is regulated. Being legal only suggests that no laws are being violated. It does not mean that there are laws that explicitly allow or promote it.

Advocates for the legalization of online gambling in India argue that regulation is necessary to protect the players and for the country to benefit from the billions of possible revenue that can be generated from online gambling. Without the relevant laws, it is difficult for defrauded players to go after fraudulent gambling sites.

Additionally, the lack of online gambling laws foregoes the possible tax revenues that can be generated from online casinos. Based on one study reported by India Post, the country is losing 10.2 billion rupees in tax and licensing revenues that could have been obtained from underground online gambling. This figure is based on a 15% tax rate.

If India passes online casino legislation that imposes doubled taxes, the country stands to generate up to 20.3 billion rupees. This is a significant amount that can be used to add to India’s COVID-19 relief spending.

While policy proposals are still pending in India’s Parliament, the best online gamblers can do is to wait and make sure that they are playing at legitimate sites.
