The SC constituted a committee to consider steps for speedy disposal of check bounce cases

The constitution bench of the Supreme Court on Wednesday directed the formation of a committee headed by former Bombay High Court judge Justice RC Chavan to take steps for speedy disposal of check bounce cases under Section 138 of the Negotiable Instruments Act To be considered. A constitution bench headed by CJI Bobde clearly presented the steps to be taken to form a committee to consider all the suggestions made in the matter and to facilitate speedy disposal of these cases through all the judiciary in the country. Found it appropriate to present a report to do. The committee may consult any expert in the matter, and submit its report within 3 months of its first meeting.  The Supreme Court told lawyer Yatin Ojha, the court has told the Union of India that it will allow the committee, including full-time or part-time secretary, to Provide secretarial assistance, allocate space for the functioning of the committee, and provide allowances, whichever is necessary.

As per the court order, the following officers are to be inducted into the committee:

 • Justice RC Chavan, a former judge of the Bombay High Court, as the chairman of the committee.

 • A representative of the Department of Financial Services, Department of Justice, Department of Corporate Affairs, Department of Expenditure and Ministry of Home Affairs, not below the rank of Additional Secretary. 

• A representative of the Reserve Bank of India nominated by the RBI Governor.

A representative of the banking industry to be nominated by the Chairman of the IBA. 

• Nalsa’s representative officer to act as the Secretary of the Committee. 

• SG Tushar Mehta or the lawyer nominated by him may be the Bar’s representative. A bench of Chief Justice SA Bobde, Justice L Nageswara Rao, Justice BR Gavai, Justice AS Bopanna and Justice S Ravindra Bhat passed.
