SC dismisses plea seeking in-house probe againist Ex-CJI Gogoi

AG KK Venugopal refuses to put former CJI Ranjan Gogoi under contempt of court for comments

The Supreme Court on Friday dismissed a PIL which was filed almost two years back that sought for an in-house inquiry against former Chief Justice of India Ranjan Gogoi for allegedly abusing his authority during his tenure as a Judge.

A bench comprising of Justices Arun Mishra, BR Gavai, and Krishna Murari dismissed the matter as in fructuous on the grounds that the ex-CJI had demitted office and therefore, nothing could be done.

The PIL was filed by Advocate Arun Ramachangra Hubalikar in 2018 that referred to the orders which were passed by former CJI Gogoi that according to him, were examples of the alleged abuse of the office of the Chief Justice. On the said ground, it prayed to inquire into the ex-CJI’s acts of “commission and omission”.

SC has however refused to entertain the plea because Justice Gogoi had demitted his office in November 2019, so the prayer to inquire his acts did not hold any relevance. Accordingly, the Supreme Court, deeming the prayer to be ineffective, dismissed the plea.
