Allahabad HC Order hard-pressed UP Officials: Supreme Court

The statement made by the apex court concerning the Allahabad HC order was since even though the top court put an end to the proceedings regarding the matter, the Allahabad HC continued to hear a contempt plea on the same. The Supreme Court added that it could not appreciate the frequent and relaxed summoning of UP officials with elevated positions. The case heard by the Bench comprising of Justices Sanjay Kishan Kaul and Hemant Gupta.

The background is a plea filed with the Supreme Court challenging the order given by the Allahabad HC. It challenged the order put forward by a single-judge bench. The UP Govt asked to pay 50% wages to the respondent when their memorandum quashed by the single-judge form. A complaint plea filed by the respondent once the HC order did not follow it.

The apex court issued a notice in the Special Leave Petition on February 22, 2021, to halt the High Court order. Following, the High Court moved to defer the contempt hearings by the parties. Despite the Supreme Court’s stay order, on March 02, 2021, the High Court directed two State Govt officials to present themselves before it.

The Supreme Court stayed the contempt proceedings followed by a conclusion that it was redundant harassment of the State officials and, the same not passed. It also criticized the summons sent by the Allahabad HC to the officials.
