Cochi Corporation and PWD directed by the High Court of Kerala to make roads & footpath convenient for the Differently-abled

Plea For Implementation of Right of Persons with Disabilities Act

The High Court of Kerala has held that it is the duty and responsibility of the Cochi Corporation to ensure that the differently abled persons get necessary arrangements, easy and convenient access to the roads and footpaths. The same was also directed to the Public Works Department.

A PIL was filed by Dr. PA Mary Anitha, who is a Chairperson of an NGO. She submitted that the poor maintenance and lack of arrangements is causing problems to the differently abled persons. The order was passed with respect to the same.

Bench of Hon’ble Chief Justice S. Manikumar and Justice Shaji P. Chaly was hearing the matter. The Court directed that like everyone else, differently abled persons too, are entitled to the fundamental rights guaranteed under Article 21 of the Constitution of India.

The Corporation and the PWD was directed by the court to maintain and repair and mould the roads and footpaths, so that the differently abled can have easy access to the same and do not have to face difficulties.

The Court further added that prompt actions be taken and the work shall be completed within three months.
