The demolition of house of UP’s MLA Vijay Mishra was stayed by the Allahabad High Court. MLA filed a writ with the HC challenging the demolition and said that the demolition of his house started only 5 minutes after the order dated November 5th, 2020 and didn’t even give him opportunity to get recourse.
The complainant also said that the authorities are behaving in a very rough manner. The court has asked the defendants to show as to why he was not given reasonable opportunity to get his recourse and also to file counter affidavit within 2 weeks.
The court said that – “Till then, no further demolition shall be carried out by the authorities concerned. It will be open for the petitioners to remove their belongings from the house in question.”
The Advocate for petitioner Lokesh Kumar Dwivedi said that the house is in name of both the petitioners but the Praygraj Development Authority gave notice only to one. It was contended before the court that the order to of demolition was on the ground of construction by previous owners which the MLA already removed in accordance with the blueprint.
