In Response to PIL, the Gauhati HC seeks the details of female foreign prisoners and their punishment period

The Hon’ble Guwahati High Court on Tuesday (11th May 2021) ordered the State Government authorities to submit the report regarding the details of the female foreigners who are currently lodged in jails with their children below the age of 6 years and the period of their punishment within two days.

The Hon’ble Court also directed the State Government to provide the details of all such intimates who according to the guidelines given by this Court as well as the Hon’ble Supreme Court are eligible to be released from jails because of COVID-19.

While dealing with Public Interest Litigation (PIL), presented through a counsel Mr. T J Mahanta, the Hon’ble Chief Justice Sudhanshu Dhulia and Hon’ble Justice Manash Ranjan Pathak observed that “the learned State counsel shall provide the details of all such persons who have been declared as a foreigner and the period for which they have been put in jail within two days.”

The State Government is also directed to inform the Hon’ble Court about the measure that is taken for dealing with congested prisons which may become a hotspot of the pandemic.

Last year, the Hon’ble Court dealt with the same kind of case but w.r.t. the children and thus, sought the details from the Assam’s Jail Authority for the number of lodged children given rising COVID-19 cases.
