Protection from Arrest to Actor Nawazuddin Siddiqui & 4 family members in Molestation Case: Allahabad High Court

On Thursday, Allahabad Court granted protection from the arrest to actor Nawazuddin Siddique and four of his family members in the connection of the molestation case filed by his estranged wife, Aliya.

Justice Manoj Misra and Justice Sanjay Kumar Pachori were hearing Siddiqui’s application for quashing the FIR.

“As the allegations would require investigation”, the court declined the plea. It is directed to the UP police to not take any corrosive action against the actor and his two brothers Fayazuddin and Ayazuddin and mother Mehrunissa. As there were specific allegations of molesting the minor child in 2012 the relief was not granted in a favour of Siddiqui’s third brother.

 “Considering that specific allegation of child abuse is against the petitioner no. 1 (Minajhuddin) only and the rest of the petitioners have been implicated by levelling general allegation, we deem it appropriate to dispose off this writ petition by providing that in so far as the petitioner no. 2 (Faiyajuddin Siddiqui); petitioner no. 3 (Ayajuddin Siddiqui); petitioner no. 4 (Smt. Mehrunisha Siddiqui); and petitioner no. 5 (Nawajuddin Siddiqui) are concerned, the investigation shall continue and brought to its logical conclusion but they shall not be arrested in the above case till submission of a police report under Section 173 (2) CrPC…”- The court added.

The FIR was filed on August 14, 2020, at Budhana Police Station in Muzaffarnagar District, under section 354 (outraging modesty of a woman), section323 (voluntarily causing hurt), section504 (insult with intent to provoke breach of peace), and section506 (criminal intimidation) of Indian Penal code.
