SC seeks response from External Affairs Minister Jaishankar

A three Judge Bench led by Chief Justice of India SA Bobde comprising with Justice AS Bopanna & Justice V Ramasubramanian issued a notice to Jaishankar to file his reply by December 8.

On Wednesday, the Supreme Court has sought the response in a petition challenging the Dr. S Jaishankar, External Affairs Minister’s election to Rajya Sabha from the Gujarat State. The said notice was accepted by Senor Advocate Harish Salve, representative of Jaishankar.

Earlier, the appellant Gaurav Panday (Congress Leader) has filed a petition in Gujarat High Court claiming that the Election Commission issuing separate notifications for holdings by-polls for casual & regular vacancies in Rajya Sabha was in violation of the law.

However, in September 2019, the Gujarat High Court dismissed the petition. Following which, Pandya has filed an appeal before the Supreme Court and he has stated that the High Court erred in law by ruling that the election petition filed by pandya was to be dismissed in limine on the ground that he was “neither a voter nor a candidate in the election in question.”    

Therefore, the Bench while hearing from both parties via video conference has said that “we will give you a short date and it will be listed on the non-miscellaneous day.”
