UP family Court Allows maintenance from wife

UP family court allowed a petition filed by the husband seeking maintenance. In the said petition husband & wife are living seperately since years & the petition was filed in 2013 under Hindu Marriage Act, 1955 seeking maintenance from wife.

The family Court allowed the complainant to get maintenance of ₹1,000 per month from his wife who is a retired government servant & getting monthly pension of ₹12,000.

Permanent maintenance (section 25 HMA,1955) means when either wife or husband is entitled to receive from the spouse for maintenance and support during the subsistence of marriage or upon separation or divorce.
