Allahabad HC Orders To Stop Encroachments On Kabaristan By Ant-social Elements

FIR has been registered against unknown persons for making objectionable and derogatory statements against the justices of Division Bench of Allahabad High court for their order against the name and shame banners.

Brief Facts:

The Division Bench of The Allahabad High Court comprising of Justices, Chief Justice Govind Mathur and Justice Ramesh Sinha took up the matter Suo motu with regard to the hoardings and banners which displayed the pictures and individual details of the protesters of CAA-NRC who also destroyed the public properties during the protests.

On 9th March, 2020, the bench directed the Uttar Pradesh Police to remove the hoardings that display the pictures and personal details of the persons who damaged the properties. Following the order, the bench has been subjected to various criticisms in the social media platforms.

One Mr.Nutan Thakur has registered First Information Report with Gomati Nagar Police Station, Lucknow under section 66 of Information Technology Act against the unknown persons who make objectionable and derogatory comments on justices in social media platforms such as facebook, Whatsapp and twitter for delivering order against the name and shame banners.

Key features:

1. The complainant states that though our constitution allows for fair criticisms on judgments, the language used in social media platforms are extremely derogatory and objectionable.

2. The complainant stated some of the hastags used in social media platforms such as ‘Justitudes’ ‘wahReCourt’ ‘BehaveJustitudes’ etc.

3. The complaint has also stated that two persons in social media had also accused the judges of division bench for having a nexus with Pakistan and hence they act to support the protest and riots.

Since the above comments were in repetitive in nature and has gone viral in social media platforms the complainant has claimed that these contents were being posted on social media purposefully with an intention to derogate the judges and hence these acts of the accuseds are in pursuance of criminal conspiracy.
